“Toast to Dad” Contest Official Rules

THE CARRABBA’S “Toast to Dad” CONTEST IS OPEN TO LEGAL RESIDENTS OF THE 50 UNITED STATES AND THE DISTRICT OF COLUMBIA AND SHALL BE CONSTRUED AND EVALUATED ACCORDING TO U.S. LAW.  DO NOT ENTER THIS CONTEST IF YOU ARE NOT LOCATED IN THE 50 UNITED STATES OR THE DISTRICT OF COLUMBIA.

NO PURCHASE NECESSARY.  A PURCHASE DOES NOT INCREASE YOUR CHANCE OF WINNING. 

DATES OF PROMOTION: The “Toast to Dad” Contest (the “Contest”) starts at 12:01 AM Eastern Time (ET) on June 1 and ends at 11:59 PM ET on June 30, 2009 (the “Contest Period”).  VOID WHERE PROHIBITED.

ELIGIBILITY:  Participants must be legal residents of the 50 United States and the District of Columbia, who are 21 years of age or older at time of entry. Employees and their immediate family members (parents, children, siblings or spouse, regardless of where they live, or persons living in same household, whether related or not) of Carrabba’s ("Sponsor"), its parent companies, affiliates, contractors, subsidiaries, distributors, sales representatives, retailers, advertising and promotion agencies, and any others engaged in the development, production, execution or distribution of this Contest, including, but not limited to, the entities supplying the prizes herein (collectively the "Contest Entities"), are not eligible to participate.

HOW TO PARTICIPATE:  Visit www.Carrabbas.com and follow the on-screen instructions to register and submit your toast and tribute to Dad in 75 words or less by 11:59 pm ET on June 30, 2009. Submissions cannot exceed 75 words.

All materials submitted for judging will be referred herein as the “submission”. Participants may enter more than once, but each submission must be unique and follow the requirements listed or the submission will be disqualified.  All submissions become the property of the Sponsor.  Submissions that contain any content determined by Sponsor and/or the judges in their sole discretion to be indecent, inappropriate, morally objectionable or otherwise unfit for advertising or publication will be disqualified.

No mechanically or programmatically reproduced submissions permitted. Sponsor will not verify receipt of submissions for participants.  By submitting an Entry Form and other required submission materials, the participant: (i) warrants and represents that he/she has read these Official Contest Rules,  is eligible to participate in the Contest and agrees to be bound thereby; (ii) warrants and represents that all of the information provided in his/her submission materials is accurate, (iii) warrants and represents that the submission materials are the original work of the participant and do not violate any third party's legal rights (including without limitation rights of copyright, trademark or other intellectual property right, privacy and/or publicity), and/or any applicable law; (iv) represents and warrants that the submission materials do not contain any disabling device, virus, worm, back door or other disruptive or malicious code that may or are intended to impair their intended performance or otherwise permit unauthorized access to, hamper, delete or damage any computer system, software, network or data; (v) consents to the use of his/her name and/or likeness by the Sponsor and its respective authorized representatives for promotional purposes in connection with the Contest (whether online, in print or through any other media now known or hereafter developed), without additional compensation and unless prohibited by law; (vi) agrees that, if selected as the winner, participant will be solely responsible for any and all resulting tax consequences; and (vii) consents to allow Sponsor to use any information contained in the submission materials for the purpose of providing participant with information about available products or services in accordance with applicable law.

In the event of a dispute regarding the identity of the person submitting an entry, the entry will be deemed submitted by the person in whose name the e-mail account is registered.  Entries will be deemed made by the authorized account holder of the e-mail address submitted at the time of entry. The authorized account holder is the natural person who is assigned to the e-mail address by an Internet access provider, on-line service provider, or other organization that is responsible for assigning e-mail addresses, or the domain associated with the submitted e-mail address. Potential winners may be required to show proof of being the authorized account holder.

JUDGING: Judges will review and select a Grand Prize winner from among all eligible submissions received. No telephone calls or correspondence will be accepted from participants inquiring regarding winners or judges’ selections.  Eligible submissions will be judged by a qualified panel of judges based upon the following criteria:

  1. Inspirational Qualities (35%)
  2. Family Spirit/Celebration of Fathers (25%)
  3. Creativity (20%)
  4. Uniqueness & Originality (20%)

In the event of a tie, the submissions involved will be judged by an additional judge who will serve as a tiebreaker.  All judging of eligible submissions will be under the supervision of a qualified panel of judges, whose decisions are final in all matters relating to the Contest. Winners will be notified by telephone or mail on or about 7-days after judging is complete.

In addition, Sponsor may, in its sole and absolute discretion, elect to promote and advertise any submission materials from participants. 

PRIZES: GRAND PRIZE: One (1) grand prize winner will receive a trip for two (2) to Napa Valley.  Grand Prize includes: 1. Two (2) roundtrip coach-class airline tickets to San Francisco or Oakland Airport from the airport nearest winner’s home, 2. four (4) nights hotel accommodations in Napa Valley, Yountville or Sonoma (based on double occupancy, or winner can opt for two rooms for two nights, single occupancy), 3. four (4) days rental of a compact or standard-size vehicle, 4.  a private tour and wine tasting at Rubicon Estate and Francis Ford Coppola Winery, and 5. one dinner with a Coppola winemaker.  Additionally, the winner will receive a case of Coppola wine and dinner for two at Carrabba’s (ARV: $3,500). 

RUNNER-UP PRIZES: Ten (10) runner-up winners will receive dinner for four and a bottle of Coppola wine at Carrabba’s (ARV: $140). 

Travel must be roundtrip.  Sponsor is not responsible for airline cancellations or delays. All expenses and incidental travel costs not expressly stated in the Grand Prize descriptions above, including but not limited to, additional ground transportation, passenger tariffs or duties, surcharges, airport fees, service charges or facility charges, additional meals, personal charges at lodging, security fees, taxes or other expenses or incidentals are the responsibility solely of winner. Winner must complete travel by June 1, 2010. Any taxes imposed on the income of the Grand Prize winner as a result of winning the Grand Prize and all other expenses not specifically mentioned herein as part of the Grand Prize are solely the responsibility of the Grand Prize winner. All travel subject to space availability at time of request, blackout dates including holidays and other restrictions may apply. Winner must give 60 days notice prior to intended date of departure. Grand Prize winner and travel companion must travel on same itinerary and must have valid required travel documents (i.e., valid photo ID) before departure. Grand Prize winner and travel companion are solely responsible for determining and obtaining, each at his/her own cost, required travel documents. All travelers must be 21 years of age or older. Travel companions must sign and return a liability/publicity release. 

No cash substitutions for prizes will be permitted, and prizes are non-refundable and non-transferable except at the sole discretion of sponsor.  Sponsor reserves the right to substitute a prize of equal or greater value.  Federal, state and local taxes are the sole responsibility of the winner.

PRIZE CLAIMS:  Except where prohibited, Grand Prize winner will be required to sign and return an Affidavit of Eligibility and Liability/Publicity release, W-9 Form, and Travel Companion Waiver (“Paperwork) within fourteen (14) days of notification in order to claim the prize.  If a potential Prize Winner fails to sign and return the Release within the required time period, the potential Prize winner forfeits his/her right to the Prize and an alternate winner will be selected.  Each potential Prize winner consents to use of his/her name, likeness, biographical information, and voice in advertising worldwide without additional compensation (TN residents will not be required to sign a publicity release as a condition of winning a prize). The Prize is taxable as income and the Prize winner is solely responsible for any taxes relating to the Prize, including, but not limited to all applicable federal, state and local taxes.

OTHER CONDITIONS:  Carrabba's, its respective affiliates, subsidiaries, parent corporations, and their respective officers, directors, shareholders, employees and agents and any and all Internet servers and access provider(s) are not responsible for: any incorrect or inaccurate entry information; human error; technical malfunctions; failures, omissions, interruptions, deletions, or defects of any telephone network, computer online systems, computer equipment, servers, providers, or software, including any injury or damage to participant's or any other person's computer relating to or resulting from participation in this Contest; inability to access the Web site, theft, tampering, destruction, or unauthorized access to, or alteration of entries; data processing that is processed late or incorrectly or is incomplete or lost due to telephone, computer or electronic malfunction or traffic congestion on telephone lines or the Internet or any Web site; printing or other errors; or any combination thereof. Proof of entering information at Web site is not considered proof of delivery or receipt.  Incomplete entries will be disqualified.  False and/or deceptive entries or acts shall render entrants ineligible.

GENERAL RULES OF PARTICIPATION: By participating in this Contest, participants, and winners release each and all of the Contest Entities, from any and all liability, damages or causes of action (however named or described) with respect to or arising out of participation in the Contest, and/or the receipt or use/misuse of the prizes awarded, including, without limitation, liability for personal injury, death or property damage.  By participating in this Contest, participants agree to be bound by these Official Rules and the decisions of the judges, which are final in all respects and not subject to appeal.  Sponsor reserves the right permanently to disqualify from this Contest any person it believes has violated these Official Rules. 

Contest Entities are not responsible for lost, late, misdirected, undeliverable or incomplete entries.  Sponsor may prohibit an entrant from participating in the Contest or winning a prize if, in its sole discretion, it determines that said entrant is attempting to undermine the legitimate operation of the Contest by cheating, hacking, deception, or other unfair playing practices (including the use of automated quick entry programs) or intending to annoy, abuse, threaten or harass any other entrants, Sponsor, or Contest Entities. If for any reason this Contest is not able to be conducted as planned, including, but not limited to, by reason of tampering, unauthorized intervention, fraud or any other causes beyond the reasonable control of Sponsor which corrupt or affect the administration, security, fairness, integrity or proper conduct of the promotion, then Sponsor reserves the right at its sole discretion to cancel, terminate, modify or suspend the Contest and judge from those submissions received prior to the date of cancellation.  CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE THE WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE PROMOTION MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING ATTORNEY’S FEES) FROM ANY SUCH ENTRANT TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION.

No Liability:  By participating, participants agree to release, discharge, indemnify and hold harmless the Contest Entities and each of their respective officers, directors, employees, representatives and agents from and against any claims made by winners, entrants, or any other third parties, related in any way to the operation of this Contest as well as any other claims, damages or liability due to any injuries, damages or losses to any person (including death) or property of any kind resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of any prize or participation in any Promotion-related activity or participation in this Contest.

CONTEST ADMINISTRATOR:  The National Sweepstakes Company, 693 East Ave., Rochester, NY 14607, whose decisions are final with regard to the conduct of this promotion. 

WINNER’S LIST REQUEST: To receive a list of major prize winners, send a self-addressed, stamped (business size) envelope to: Carrabba’s “Toast to Dad” Winner’s List Request, PO Box 10505, Rochester, NY  14610.  Requests must be received by July 31, 2009.
